Terms of Service
1. Acceptable Use Policy: a. Users are prohibited from engaging in any activities related to mining, pornographic content, hacking, or any other illegal or unethical activities, as well as activities prohibited by Dutch law. b. Users must comply with all applicable laws, regulations, and industry standards, including those specific to the Netherlands. c. Users are responsible for maintaining the security of their accounts and ensuring that their activities do not disrupt the service for other users. d. Any violation of this policy may result in immediate suspension or termination of the user's account. e. Users are responsible for the content and activities originating from their account, including content uploaded, transmitted, or accessed through their VPS or Dedicated server.
2. Prohibited Content: a. Users may not host, upload, or distribute any material that is obscene, offensive, defamatory, or illegal, including content prohibited by Dutch law. b. Users may not engage in any activities that infringe upon intellectual property rights, including copyright, trademark, or patent infringement. c. Users are responsible for ensuring that the content they host does not infringe on the rights of third parties. d. We reserve the right to remove or disable any content that violates these terms without prior notice.
3. Resource Usage: a. Users must not engage in any activities that consume excessive server resources, which may negatively impact the performance of other users. b. Users must not engage in activities that may cause network congestion or disrupt the overall stability of the hosting environment. c. Users are responsible for regularly monitoring their resource usage and taking necessary steps to optimize their applications or scripts. d. We reserve the right to restrict or limit resource usage in case of excessive consumption that affects the overall server performance.
4. Privacy and Data Protection: a. Users' personal information and data will be handled in accordance with applicable privacy laws and our privacy policy. b. Users are responsible for maintaining the confidentiality of their login credentials and any sensitive information stored on their VPS or Dedicated server. c. We employ industry-standard security measures to protect user data, but we cannot guarantee the complete security of user information. d. Users are encouraged to keep their applications and scripts updated to mitigate security risks.
5. Payment and Refunds: a. Cloudto operates on a prepaid balance system, where users must maintain a positive balance to use the services. b. Payments can be made through specified payment methods, as listed on our website. c. Refunds can be requested within 7 days of the initial payment if the user has not utilized their prepaid balance. d. If a client fails to maintain a sufficient balance on their account, their services may be suspended. e. If the client does not top up their funds within 7 days, the data associated with their service may be permanently deleted. f. Once the client tops up their funds within 7 days, the service will be automatically unsuspended.
6. Suspension and Termination: a. Services may be suspended if a client fails to comply with the terms of service, including but not limited to abuse, violation of acceptable use policy, or non-payment. b. We reserve the right to suspend or terminate user accounts that violate these terms of service without prior notice. c. In case of violations, we will make reasonable efforts to notify users and provide an opportunity to rectify the situation before taking any action.
7. Service Level Agreement (SLA): a. We strive to provide a reliable hosting service, but we cannot guarantee uninterrupted or error-free operation. b. We shall not be held liable for any damages or losses resulting from service interruptions or downtime. c. We will make reasonable efforts to promptly address any technical issues or disruptions in service. d. In the event of planned maintenance or upgrades, we will provide advance notice to minimize any potential impact on users.
8. Indemnification: a. Users agree to indemnify and hold us harmless from any claims, liabilities, damages, or costs arising from their use of the VPS and Dedicated server hosting services or any violation of these terms. b. Users are responsible for any content they host or transmit through their VPS or Dedicated server and any consequences that may arise.
